Article 2 — Purpose and scope

These general terms and conditions of sale govern all sales concluded on the Zonebazar website between the seller identified in Article 1 and any buyer acting as a consumer, within the meaning of the French Consumer Code.

Placing an order implies unreserved acceptance of these terms and conditions. They can be consulted at any time on the website and prevail over any other terms.

The seller reserves the right to amend them. The applicable terms are those in force on the date of the order.

Article 3 — Products

The products offered are jewellery and fashion accessories, homeware, car and phone accessories, and pet supplies, while stocks last at our partner suppliers.

Each product page specifies the essential characteristics: materials, dimensions, weight, colours and available variants. The photographs are as faithful as possible but are not contractually binding: slight variations in shade may occur depending on screens and production batches.

Items described as containing natural materials — leather, mother-of-pearl, stones — by nature show variations in appearance from one piece to another. These variations do not constitute a defect.

Article 4 — Prices

Prices are shown in euros, for a delivered item.

VAT not applicable, Article 293 B of the French General Tax Code (code général des impôts). The seller is covered by the VAT basic exemption scheme: no value added tax is charged, and none can be recovered by a business buyer.

Delivery charges are included in the price shown for mainland France and the Member States of the European Union: no shipping charge is added at checkout, whatever the order amount or the weight of the parcel.

For any other destination, delivery charges are €8.99 per order. The exact amount is shown before payment is confirmed: no charge is added afterwards.

The seller reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is confirmed.

Article 5 — Orders

An order follows these steps:

  1. selection of the items and their variants, and adding them to the basket;
  2. checking the details of the basket, with the option to correct it;
  3. entering contact details and the delivery address;
  4. acceptance of these general terms and conditions;
  5. confirmation of payment, which constitutes conclusion of the contract.

A confirmation email summarising the order is sent to the buyer. The seller recommends keeping it.

The seller reserves the right to refuse or cancel any order where there is a legitimate reason, in particular in the event of a previous dispute, an order that is abnormal in relation to usual quantities, or an obvious pricing error.

Article 6 — Payment

Payment is made online, in full, by the methods indicated when the order is placed. Transactions are secured by the payment provider, and the seller never has access to the buyer's bank details.

The order is processed once payment has actually been received.

Article 7 — Delivery

7.1 Areas served

Deliveries are made to mainland France and the 27 Member States of the European Union. No delivery is offered outside this area.

7.2 Lead times

Orders are shipped within 1 to 3 working days after payment is confirmed.

Delivery then takes place within an estimated 10 to 20 days from the order. This is an estimate and not a firm commitment: the items are shipped from our partner suppliers located outside the European Union, and transit times may vary depending on the destination and customs procedures.

In accordance with Article L216-1 of the French Consumer Code, the seller undertakes to deliver no later than thirty days after the conclusion of the contract. After this period, the buyer may give the seller formal notice to deliver within a reasonable additional period and then, failing performance, terminate the contract by registered letter or in writing on a durable medium. The seller then refunds all sums paid, no later than fourteen days after termination.

7.3 Customs duties and taxes

Orders delivered within the European Union do not give rise to any customs duty or additional charge payable by the buyer: import formalities and taxes are borne by the seller and included in the price shown.

7.4 Tracking and receipt

A tracking link is sent as soon as the order is shipped. On receipt, the buyer is invited to check the condition of the parcel. In the event of damage or missing items, it is recommended — although this does not affect the buyer's rights — to record reservations with the carrier and to inform the seller.

Risk passes when the goods are physically handed over to the buyer: any loss or damage occurring during transport is borne by the seller.

Article 8 — Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the buyer has a period of fourteen clear days from receipt of the goods to exercise the right of withdrawal, without having to give reasons for the decision or bear any penalty.

Where the order covers several items delivered separately, the period runs from receipt of the last item.

8.1 How to withdraw

The buyer informs the seller of the decision by any unambiguous statement sent to support@zonebazar.com, or by using the form set out in the annex to these terms.

8.2 Returning the goods

The buyer returns the goods without undue delay and no later than fourteen days after communicating the decision. The cost of returning the goods is legally borne by the buyer.

Goodwill gesture from the seller: for any order of less than €30, the seller waives the return of the goods and issues a refund without the item being sent back. This option is offered to the buyer and does not restrict any of the buyer's rights.

8.3 Refund

The seller refunds all sums paid, including standard delivery charges, no later than fourteen days from recovery of the goods or from proof of their dispatch, whichever occurs first. The refund is made using the same means of payment as that used for the order, unless otherwise agreed.

8.4 Exceptions

The right of withdrawal does not apply to goods made to the buyer's specifications or clearly personalised, nor to sealed goods which have been unsealed and cannot be returned for hygiene reasons.

Article 9 — Legal guarantees

The seller is liable for any lack of conformity of the goods with the contract under the conditions of Articles L217-4 et seq. of the French Consumer Code, and for latent defects under the conditions provided for in Articles 1641 et seq. of the French Civil Code.

When acting under the legal guarantee of conformity, the consumer:

  • has a period of two years from delivery of the goods in which to act;
  • may choose between repair and replacement of the goods, subject to the cost conditions laid down in Article L217-9;
  • is exempt from having to prove the existence of the lack of conformity during the twenty-four months following delivery of the goods.

The legal guarantee of conformity applies regardless of any commercial guarantee that may have been granted.

The consumer may decide to invoke the guarantee against hidden defects in the goods sold within the meaning of Article 1641 of the French Civil Code. In that case, the consumer may choose between cancellation of the sale and a price reduction, in accordance with Article 1644 of the French Civil Code.

9.1 Making a claim

Any claim should be sent to support@zonebazar.com, accompanied if possible by a photograph of the defect found.

The cost of returning goods that do not conform or have a latent defect is borne by the seller. In practice, the seller replaces or refunds the goods without requiring them to be returned.

Article 10 — Liability

The seller cannot be held liable for non-performance of the contract in the event of force majeure, an unforeseeable and insurmountable act of a third party, or fault on the part of the buyer.

The products comply with the French and European regulations in force. It is the buyer's responsibility to use them in accordance with their intended purpose and with the precautions given on the product page.

Article 11 — Personal data

The data collected is necessary for processing the order, invoicing and after-sales service. It is processed in accordance with Regulation (EU) 2016/679 and the French “Informatique et Libertés” Act.

Data controller: the operator identified in Article 1. Details of the processing, retention periods and your rights are set out in our privacy policy.

The data is kept for as long as necessary to manage the business relationship and to meet accounting and tax obligations, i.e. ten years for accounting records. It is shared only with the providers involved in fulfilling the order — payment provider, carrier, host.

The buyer has the right of access, rectification, erasure, restriction, objection and portability, which can be exercised by writing to support@zonebazar.com. The buyer may lodge a complaint with the CNIL (www.cnil.fr).

Article 12 — Intellectual property

All elements of the website — texts, photographs, layout, brand — are protected by copyright and trade mark law. Any reproduction, even partial, is prohibited without prior written authorisation.

Article 13 — Mediation and dispute resolution

In the event of a problem, the buyer is invited to contact the seller at support@zonebazar.com in order to seek an amicable solution.

All complaints are handled in writing. The buyer is invited to set out the request as precisely as possible, stating the order number.

In accordance with Articles L611-1 et seq. of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with a trader, after having attempted to resolve it directly with that trader by means of a written complaint.

The appointment of the seller's consumer mediator is in progress. The mediator's contact details will be published in this article as soon as they are available, and sent without delay to any buyer who requests them at support@zonebazar.com.

This situation does not deprive the buyer of any remedy: the buyer remains free at any time to refer the matter to the competent court under the conditions of Article 14, and to report a dispute to the departmental directorate for the protection of the population (direction départementale de la protection des populations) responsible for their area.

Article 14 — Applicable law

These terms and conditions are governed by French law. The protective provisions of the law of the European consumer's State of habitual residence remain applicable where they are more favourable to the consumer.

Failing an amicable resolution, the dispute may be brought before the competent court. The consumer may refer the matter, at their choice, to the court for their place of residence or to the court for the seller's registered office.
